Welcome to FolioReview. These Terms of Service govern your use of the FolioReview website, app, and services (together, the "platform"). By accessing or using the platform, you agree to these terms.

1. About the platform

FolioReview is an online platform that connects creators with mentors for portfolio reviews and creative feedback. Mentors offer critiques and guidance based on their professional experience. FolioReview provides the infrastructure to facilitate these interactions but does not provide the reviews itself.

FolioReview operates as an agent. Mentors are independent professionals providing their own services. When you book a review, the contract for that review is between you and the mentor; FolioReview is not a party to that contract. We facilitate introductions, payment processing, and the platform itself.

2. User accounts

To use most features of the platform you need to create an account. You agree to:

  • Provide accurate information.

  • Keep your login details secure.

  • Be at least 18 years old (or have permission from a parent or guardian).

  • Be responsible for activity that occurs under your account.

  • Only hold one active account at a time.

You can delete your account at any time from within the app or by contacting us. FolioReview reserves the right to suspend or terminate accounts that violate these terms.

3. Services and reviews

Creators may submit work, links, or documents for review by a mentor. Mentors provide feedback in two formats:

  • Recorded Critiques: Video feedback recorded through the platform and delivered to the creator.

  • Live Meetings: Real-time video consultations scheduled between the creator and mentor via the platform's tools.

FolioReview does not guarantee specific outcomes, career advancement, or professional opportunities. All feedback represents the opinion of the mentor. Reviews are a private, one-to-one service. You may not publish or share your review online without your mentor's express permission.

4. Messaging

The platform provides a messaging feature to allow creators and mentors to communicate regarding bookings. The following rules apply to platform messaging:

  • Opt-Out: The messaging feature can be turned off at any time in your account settings if you do not wish to receive direct messages.

  • Blocking Users: You have the ability to block other users at any time, which can be done directly within both the mobile app and the desktop interface.

  • No Official Reviews via Chat: The messaging feature is for general communication and logistical coordination only. It must not be used to conduct or deliver the formal portfolio reviews or creative feedback, which must occur via the designated Recorded Critique or Live Meeting tools.

5. Live Meetings

Where a Live Meeting is booked, the following additional rules apply:

  • Attendance: Both parties are expected to be punctual. If you fail to attend a scheduled meeting within 15 minutes of the start time, the mentor may end the session, and no refund will be issued.

  • Technical Issues: FolioReview is not responsible for interruptions caused by your internet connection or hardware. If the mentor experiences a total technical failure or fails to attend, you will be entitled to a reschedule or a refund.

  • Conduct: Live sessions must remain professional. Any harassment will result in the immediate termination of the session and potentially your account, without a refund.

  • Recording: Live meetings may be recorded for quality, safety, or playback purposes. You may not record the session using external software without the mentor’s express consent.

6. Mentor obligations

Mentors who use the platform agree to:

  • Provide professional, constructive feedback in good faith.

  • Be solely responsible for any income tax, VAT, National Insurance, and other taxes.

  • Not solicit clients off-platform during an active booking.

  • Not impersonate, misrepresent, or claim affiliations they don't have.

If a mentor consistently fails to deliver, behaves unprofessionally, or breaches these obligations, FolioReview may suspend or terminate their account.

7. Payments

Prices are shown in GBP and processed through third-party providers, including Stripe. Mentors set their own prices and delivery timeframes. By purchasing a review you agree to the listed price, the mentor's timeframe, and a small platform service charge shown at checkout.

FolioReview takes a commission from each transaction. Mentors who are VAT-registered are responsible for accounting for their own VAT. Payouts are settled through Stripe Connect.

8. Refunds and consumer rights

If a mentor declines a booking or fails to deliver a recorded review within the stated window, you will be refunded automatically.

  • For Recorded Reviews: Under UK consumer law, you normally have 14 days to cancel a digital service. By booking, you request the service begins immediately and acknowledge you lose the right to cancel once the mentor accepts the booking.

  • For Live Meetings: You may cancel or reschedule up to 24 hours before the start time. If you cancel with less than 24 hours' notice, or fail to attend, the mentor is entitled to the full fee. Once a live meeting has concluded, the service is deemed fully performed and is non-refundable.

9. User content

You confirm that you own the rights to the content you upload or have permission to share it. You grant FolioReview a non-exclusive, worldwide licence to host, display, and transmit your content for the purpose of operating the platform (e.g., showing work to your mentor).

10. Acceptable use

You agree not to upload illegal, sexual, or infringing content; harass users; spam; or attempt to disrupt the platform. FolioReview may remove content or terminate accounts that violate these rules.

11. Platform role & Liability

FolioReview acts as an intermediary. To the fullest extent permitted by law, FolioReview is not liable for indirect or consequential losses. Our total liability is limited to the amount you paid for the specific booking in question. The platform is provided on an "as is" basis.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes and General

We may update these terms from time to time with 14 days' notice for material changes. If any part of these Terms is found to be unenforceable, the rest will continue to apply.
